Quality Control

Swift Innovations take utmost care in following stringent quality controls in all its processes including formulation of new products, production, storing, batch coding, labelling and batch coding.

Inventory Control

Including when production and until the goods are delivered, Swift Innovations takes all steps to safeguard the inventory of the customer’s products to protect it at all times from theft, damage or other loss in accordance with best practices in the industry and in strict compliance with the specifications and terms of this agreement. The customer shall have the right at any time upon reasonable notice and during regular business hours (unless otherwise agreed) and at the customer’s expense to inspect and perform a physical count of the inventory of the customer’s products using such personnel of the customer or the customer’s representatives (including auditors) as the customer determines to use in its sole discretion.

Quality Control Records and Samples

Swift Innovations may retain one to six (1-6) samples for quality control purposes from each production batch of each of the products for a period of 2 years.

New Product Development

Swift Innovations shall use its best efforts to assist the customer in the development of new products and/or the modification of existing products to reduce costs and/or improve quality. All product development activities conducted for the customer in the Swift Innovations’ laboratory will be the Swift Innovations’ responsibility excluding the cost of ingredients utilized.
Swift Innovations will provide an estimated timeline for formulation and manufacturing process; however, these timelines may be adjusted based on customer response time, vendor ingredient supply delivery, government testing period, and the company’s manufacturing schedule.
Any changes to the formula or manufacturing requirements must be communicated in writing by the customer and sent to Swift Innovations pursuant to the notice provisions herein.

Formula and Packaging Standards

While the regulatory approval for the product is responsibility of the customer, the Swift Innovations will advise on the testing requirements suggested by Health Canada (as required but not limited to bacteria, heavy metals and accelerated stability testing) and will carry out those tests at the Customers’ approval and expense. If the customer alters the formula and/ or packaging for any reason, the customer then assumes responsibility for meeting the Health Canada testing standards. The customer will hold Swift Innovations harmless from, any resulting bodily injury/property damage or if the product does not perform its intended function.
Accelerated stability testing must be conducted in the final retail packaging, for a 90-day period. If the customer elects to forfeit the full testing period or does not provide the final packaging within the time permitted, Swift Innovations is not liable for the formula stability. Formula, packaging, and artwork/label approval must be confirmed in writing; addition changes must be requested in writing and may result in additional fees. Customer approved formulas will be assigned a unique batch number for each manufacturing run to record the outcomes of each production.
While Swift Innovations will provide guidance on Canadian manufacturing/ testing standards for formulation and artwork, the customer is ultimately responsible for meeting Health Canada or relevant guidelines. The customer is fully responsible for all international manufacturing, label or other regulatory guidelines, these specifications must be provided to Swift Innovations in writing.

Rejection of Products

The customer may reject the products within five (5) business days of delivery only if the product would be subject to a recall because of the presence of any bacteriological agent or like substance that are established to be of public health concern when the following criteria has been established:
(i) there is physical evidence that the products have been materially damaged during manufacturing, or handling while the products were in the Swift Innovations’ custody, or
(ii) are not in material compliance with the terms and conditions of any other signed Agreement.
The Manufacturer is responsible for the quality of formulations and complete finished products prior to release. After release, the customer is responsible for shipping (handling guidelines and fees), storage (within 4-24⁰C), and distribution of the goods. For bulk formula sales, the customer is responsible for the quality of the formulations after the vessel/drum has been opened.
In the case where the final product is compromised for the reasons above, Swift Innovations reserves the discretion to provide options to re-establish Health Canada standards for the units or batch that did not comply.
Swift Innovations and customer will evaluate options and choose a cost effective mutually beneficial solution.
Depending on the agreed upon solution, the Manufacturer may incur costs for product replacement or provide a credit towards future orders, payment refunds will not be considered.
